QRT JOBS DMCA / Copyright Infringement Policy

  1. Introduction

QRT JOBS (qrtjobs.com) respects the intellectual property rights of others and is committed to complying with applicable copyright laws, including the procedures outlined in the U.S. Digital Millennium Copyright Act (“DMCA”) and the relevant provisions of the Indian Copyright Act, 1957.

This policy outlines the process for submitting copyright infringement claims (Takedown Notices) regarding content posted by users on our job portal, as QRT JOBS acts as an “intermediary” between employers/recruiters and job seekers.

  1. Procedure for Reporting Copyright Infringement (Takedown Notice)

If you believe that any content on QRT JOBS infringes upon your copyright, you must submit a written Takedown Notice to our Designated Agent containing substantially the following information:

  1. A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit QRT JOBS to locate the material (e.g., the specific URL/link).
  4. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address.
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Upon receipt of a complete and valid notice, QRT JOBS will take the following actions:

  • Remove or disable access to the allegedly infringing material.
  • Notify the user/poster of the material that access has been removed or disabled.
  • Inform the complaining party of the action taken.
  1. Counter-Notification Procedure

If you believe that your content was removed or disabled as a result of mistake or misidentification, you may submit a written counter-notification to our Designated Agent.

The counter-notification must contain substantially the following information:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled (i.e., the original URL).
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and email address.
  5. A statement that you consent to the jurisdiction of the courts in [Specify City/Jurisdiction in India, e.g., New Delhi], India, and that you will accept service of process from the person who provided the original Takedown Notice or an agent of such person.

Upon receipt of a valid counter-notification, QRT JOBS may send a copy of the counter-notification to the original complaining party, informing that person that we may replace the removed material or cease disabling access to it in 10 to 14 business days. Unless the copyright owner files an action seeking a court order against the user, the removed content may be restored.

  1. Policy for Repeat Infringers

QRT JOBS reserves the right, in its sole discretion, to terminate user accounts (including recruiters, employers, or job seekers) who are determined to be repeat infringers of copyrighted works. We will maintain records of notices concerning user accounts for this purpose.
